1. Acceptance of Terms

By accessing this website, requesting an estimate, approving an estimate, accepting an invoice, signing a contract, or otherwise engaging Heritage Plumbing Services, LLC (“Heritage Plumbing”), you agree to these Terms, Conditions, and Disclosures. If you do not agree, do not use this website or our services.

2. Service Area & Scope of Services

Heritage Plumbing is a Washington Limited Liability Company providing residential and commercial plumbing services in Southwest Washington, including Clark, Cowlitz, and Skamania Counties.

Services may include, without limitation, emergency plumbing, water heater installation and service, sewer line repair and replacement, drain cleaning, diagnostic work, leak detection, pipe repair, repiping, fixture replacement, and related plumbing services. All services are subject to site conditions, accessibility, system condition, materialavailability, and applicable code requirements.

3. Scope Exclusions

Unless expressly stated in writing, services do not include drywall, texture, paint, finish restoration, framing, structural modifications, electrical work including grounding or bonding, landscaping, concrete, paving, cabinetry, appliance connections, moving or relocating fixtures, mold, lead, asbestos, or other hazardous material testing or remediation, correction of unrelated pre-existing deficiencies, or any work not specifically listed in the approved scope.

Additional work required due to hidden conditions, code issues, system failure, access limitations, or customer-requested changes will require additional authorization and may
increase the price.

4. Estimates, Pricing & Change in Scope

All estimates are provided in good faith based on visible and reasonably known conditions and are not guaranteed unless expressly stated in writing. Final price may change due to concealed conditions, code compliance requirements, product selection changes, field conditions, customer-requested revisions, or material availability.

Any deviation from the original scope, including unforeseen conditions, may require a written change order or other written customer authorization before additional work proceeds.

5. Deposits, Invoicing & Payment Terms

Heritage Plumbing may request a deposit under the following conditions:

  • Non-permitted work: 50% deposit upon acceptance and 50% due at completion.
  • Permitted work: 50% deposit upon acceptance, 40% due at substantial completion, and 10% due after passed inspection.

Emergency, after-hours, or same-day services may be billed at premium rates.

Unless otherwise stated in writing, all invoices are due immediately upon receipt. Accepted payment methods may include credit card, ACH, and check. Washington sales tax is applied in accordance with applicable state and local law.

A 3% credit card processing fee applies where disclosed and permitted.

6. Right to Refuse or Stop Work

Heritage Plumbing reserves the right to refuse, suspend, or discontinue service if unsafe conditions exist, access is not provided, hazardous materials are encountered, required approvals are delayed, customer interference prevents safe work, or payment terms are not met.

7. Customer Responsibilities

Customer agrees to provide safe and reasonable access to all work areas, including crawlspaces, attics, mechanical rooms, basements, utility closets, and exterior access points; disclose known hazards or plumbing issues; secure pets, children, and valuables; and maintain a safe work environment.

Customer is responsible for providing required adult access, utilities, and inspection access when applicable.

8. Existing Conditions/Pre- Existing Systems

Customer acknowledges that plumbing systems may contain aged, brittle, corroded, scaled, improperly installed, concealed, or otherwise compromised materials or components. Heritage Plumbing is not responsible for failure of pre-existing systems or materials that occurs during or after ordinary service work where those conditions were not caused solely by Heritage Plumbing’s negligence.

9. Drain Cleaning & Diagnostic Services Disclaimer

Drain cleaning, cabling, jetting, descaling, camera inspection, leak detection, and similar diagnostic or restorative services are intended to improve flow or identify likely issues, but do not guarantee permanent repair or full system integrity.

Drain and sewer piping may be deteriorated, offset, cracked, root-intruded, collapsed, scaled, back-pitched, separated, or otherwise compromised. Heritage Plumbing is not responsible for failure of fragile or compromised piping during or after normal drain cleaning or diagnostic operations where such failure is due to pre-existing conditions. Additional repair or replacement may be required.

10. Permits & Code Compliance

Heritage Plumbing will obtain plumbing permits when included in the scope or required by the agreed service arrangement, unless otherwise stated in writing. Code-required corrections discovered during the work may require additional labor, material, or separate authorization.

Customer is responsible for inspection access and any reinspection fees not caused by Heritage Plumbing.

11. Website Disclaimer

Heritage Plumbing does not test for or remediate asbestos, lead, mold, or other hazardous materials. If suspected hazardous materials are encountered, work may stop until the issue is evaluated or remediated by an appropriately licensed specialist.

12. Delays/Force Majeure

Heritage Plumbing is not responsible for delays or failure to perform caused by weather, acts of God, supply chain disruption, utility interruptions, labor shortages, permit or inspection delays, manufacturer backorders, third-party contractor delays, or other circumstances beyond Heritage Plumbing’s reasonable control.

13. Third-Party Products, Suppliers & Other Contractors

Heritage Plumbing is not responsible for delays, defects, damage, or performance issues caused by manufacturers, suppliers, utility providers, inspectors, customer-selected products, owner-furnished materials, or work performed by others.

14. Warranty

Any workmanship warranty applies only as expressly stated on the applicable invoice, estimate, contract, or other written Heritage Plumbing document. Manufacturer warranties apply separately according to the manufacturer’s terms.

Warranties do not cover misuse, neglect, abuse, freezing, corrosion, chemical damage, water quality issues, normal wear and tear, lack of maintenance, customer-supplied materials, acts of third parties, or unrelated/pre-existing system conditions.

15. Limitation of Liability

To the fullest extent permitted by law, Heritage Plumbing’s total liability arising out of or relating to the website, estimates, invoices, contracts, or services is limited to the amount actually paid for the specific service giving rise to the claim. Heritage Plumbing is not liable for incidental, special, indirect, exemplary, or consequential damages, including loss of use, loss of profits, water damage escalation, business interruption, alternate housing, or similar losses.

16. Collections, Attorney Fees & Disputes

Customer agrees to pay reasonable collection costs, court costs, and attorney fees incurred by Heritage Plumbing in collecting unpaid amounts or enforcing this agreement, to the extent permitted by law. These terms are governed by Washington law.

17. Website Use Disclaimer

Website content is provided for general informational purposes only and does not constitute engineering, plumbing, code, legal, tax, or technical advice for any specific property or condition. Plumbing systems vary and may involve hidden conditions. Use of website information is at your own risk.

Use of this website, contact forms, or online scheduling tools does not by itself create a contractor-client relationship.

18. Privacy Policy

Heritage Plumbing may collect personal information including name, phone number, email address, service address, scheduling information, payment information processed by third-party providers, and website usage data such as cookies, IP address, and analytics.

This information may be used to schedule and perform services, process payments, communicate about appointments and invoices, provide customer support, maintain internal records, improve the website, and send service or marketing communications where permitted.

Heritage Plumbing may use third-party service providers including payment processors, analytics providers, CRM/service management platforms, and advertising platforms. Heritage Plumbing does not sell personal information.

19. Communication Consent

By contacting Heritage Plumbing or submitting your information, you consent to receive communications by phone, email, and text message regarding scheduling, reminders, invoices, service updates, follow-up, and marketing, subject to your opt-out rights and applicable law. Message and data rates may apply.

20. Intellectual Property

All website content, including text, graphics, logos, photos, layout, and branding, is the property of Heritage Plumbing or its licensors and may not be copied, republished, or used without written permission.

21. Washington Contractor & Plumbing Disclosure

Heritage Plumbing Services, LLC is registered, bonded, insured, and licensed in the State of Washington.

Consumers may verify contractor registration, workers’ compensation coverage, safety history, bond lawsuits, and related information through Washington State Labor & Industries’ contractor verification tools.

Important Washington Notice: If your contract exceeds $1,000, Washington law requires a signed disclosure statement, and the contractor must retain a signed or electronic copy for at least 3 years. The official disclosure warns that the contractor bond or deposit may not be enough to cover a claim, that the property may be liened if suppliers or subcontractors are not paid, and that customers may request lien release documents.

22. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.

23. Entire Agreement

To the extent allowed by law, these Terms apply together with any approved estimate, invoice, signed contract, change order, or warranty document issued by Heritage Plumbing. If there is a conflict, the more specific written project document controls for that job.
